The case centers around Jamie Lee and several other former employees who claim they were improperly compensated during their tenure at Alacrity Adjusting Solutions LLC. According to the complaint, these employees were paid on a day rate basis ranging from $525 to $575 per day without any overtime premium for hours worked beyond forty in a week. This payment structure allegedly resulted in numerous instances where employees worked over sixty hours weekly without appropriate compensation. "Defendant did not pay any Plaintiff an overtime premium for hours worked past forty in a workweek," states the complaint.
Jamie Lee's legal team argues that this practice violates FLSA's requirements for overtime pay and that Alacrity Adjusting Solutions LLC operated with an intentional disregard for these laws. The complaint further claims that the company's timekeeping system was designed to prevent employees from logging more than ten hours per day, effectively obscuring actual working hours and hindering accurate record-keeping.
