Plaintiffs Allege Defective IVC Filter Caused Severe Injuries

Shannon McGuire, a United States veteran, and his wife Susan McGuire have filed a lawsuit against B. Braun Medical Inc., B. Braun Interventional Systems Inc., and B. Braun Medical in the United States District Court for the Eastern District of Louisiana on February 26, 2025. The complaint accuses these corporations of manufacturing and distributing a defective medical device that has caused significant harm to Shannon McGuire.

The lawsuit centers around an inferior vena cava (IVC) filter known as the VenaTech LP, which was surgically implanted in Shannon McGuire on September 13, 2008, at St. Tammany Parish Hospital to prevent blood clots from reaching his heart and lungs. However, the device allegedly failed when it tilted, perforated, and fractured inside his body. This failure led to severe medical complications including extreme pain, suffering, and disability for Mr. McGuire. According to the complaint, the plaintiffs discovered the extent of these issues only after a CT scan on June 12, 2024.

The plaintiffs argue that B. Braun Medical Inc., along with its affiliates B. Braun Interventional Systems Inc., and B. Braun Medical (a French corporation), were negligent in their design and marketing of the VenaTech LP filter system. They claim that despite knowing about the potential risks associated with their product—such as breakage and migration—the defendants continued to market it as safe without adequate warnings or instructions for use. "Defendants concealed the known risks," states the complaint, accusing them of violating several provisions under the Louisiana Product Liability Act (LPLA).

Shannon McGuire seeks compensation for ongoing medical expenses and loss of quality of life due to this alleged negligence while Susan McGuire claims loss of consortium resulting from her husband's injuries. The plaintiffs are demanding general damages according to proof at trial alongside special damages covering economic losses incurred by these injuries.

Scandurro from Scandurro & Layrisson L.L.C., they are also requesting prejudgment interest as permitted by law along with attorney fees and other relief deemed appropriate by the court under case number 2:25-cv-00393-SSV-JVM.
