Safeway sued over unpaid theft claim

Jewel Addison filed suit against Safeway Insurance Co. of Louisiana on April 20 in the Orleans Parish District Court, over an unpaid theft claim.

Addison claims his 1999 Ford Explorer was stolen outside his home on May 3, 2009, then discovered the following day damaged to the extent it was a total loss. He claims he filed a timely notice with his insurance company, but Safeway has not paid the claim.

In the suit, he claims he fully complied with Safeway's investigation and adjustment of his loss but he was not provided a reasonable explanation for its refusal to pay his loss.

Addison is seeking damages for loss of vehicle use, property damage to his vehicle, mental anguish and distress, damages for breach of insurance contract, statutory penalties, attorney fees, legal interest and court costs.

New Orleans attorney David E. Kavanagh of Kavanagh & Rendeiro is representing Addison.

Judge Piper D. Griffin is assigned to the case.
