Hospital overpaid nurse $75k in shift bonus, suit claims

Triumph Louisiana Specialty Hospital filed suit against one of its nurses, claiming she was incorrectly issued more than $75,000 in shift bonus pay.

In an attempt to regain the overpayment, Louisiana Specialty Hospital, doing business as Triumph Louisiana Specialty Hospital, filed suit against Wilma Adams on May 19 in federal court in New Orleans.

According to the lawsuit, Adams was formerly employed by Triumph on an at-will basis as an licensed practical nurse. In March, Adams was issued a direct deposit in the amount of $77,082.50, which included an overpayment in the amount of $75,224.70, according to the Hospital.

The hospital claims that upon noticing its error it notified Adams of the overpayment and demanded the return of its property. However, the Adams has refused to return the overpayment and continues to assert that she has ownership to the overpaid bonus, the suit claims.

"Triumph is without other remedy at law to recover the overpayment," the lawsuit states.

The hospital is asking the court to award damages, costs, plus interest and the imposition of a constructive trust on the money that is in dispute.

Phillip A. Martin of Fultz Maddox Hovious & Dickens in Louisville, Ky. and J. Alan Harrell pf Baton Rouge are representing Triumph Louisiana Specialty Hospital.

U.S. District Judge Martin L.C. Feldman is assigned to the case.
