Truck driver claims injuries from tripping in pothole

Truck driver Kevin Sedman filed suit against TA Operating, doing business as Petro Stopping Centers, claiming injuries from tripping in a parking lot pothole.

The incident took place June 23, 2009, early in the morning, as Sedman exited his truck and walked across a parking lot at the Winn Dixie Distribution Center in Hammond, states his complaint filed in federal court in New Orleans on May 18.

Sedman claims that Petro Stopping Center knew or should have known of the pothole and that it caused an unreasonably dangerous condition to pedestrians. Further, Sedman states that the defendant should have repaired the pothole or placed a sign or other warning indicating the presence of the hole and also provided adequate lighting in the parking lot.

Sedman is seeking more than $ 1 million in damages for permanent, disabling injuries, emotional distress, loss of enjoyment of life, loss of wages, temporary and permanent impairment to his wage earning capacity, interest and court costs.

He claims he tore his medial meniscus.

U.S. District Judge Helen G. Berrigan is assigned to the case.
