Contractors sue church claiming breach of contract

Two construction companies are suing a New Orleans church for failing to pay for work that went into remodeling its building.

Benroe Housing Initiatives and Renaissance Coatings filed suit against Living Witness Church of God in Christ May 18 in Orleans Parish District Court.

According to the lawsuit, the parties entered into a contract Aug. 29, 2008 for the remodeling of the church on Oretha Castle Haley Boulevard in New Orleans. Benroe Housing Initiatives and Renaissance Coatings says the church hired them as contractors on the project. They say they were responsible for supervising the employees and subcontractors completing the remodel.

Benroe Housing Initiatives and Renaissance Coatings claim the defendant made an initial payment for supplies but has not paid the remaining expenses, totaling more than $37,000.

"The defendant's actions were done in a willful, reckless and wanton manner and in complete disregard for Benroe Housing Initiatives and Renaissance Coatings, LLC's right to rely on good faith performance of the contract by the defendant," the lawsuit reads.

The plaintiffs are seeking damages for the unpaid contract work and expenses, plus interest and attorney's fees.

Kenner attorney Kurt C. Garcia is representing the contractors.

Judge Lloyd J. Medley is assigned to the case.
