Slip and fall at Winn-Dixie leads to lawsuit

A Jefferson Parish woman is suing a grocery chain after allegedly slipping and falling on a wet floor.

Claiming the store was negligent for failing to dry the floor, Nery Freire filed suit against Winn-Dixie Montgomery, Southern Cleaning Services and ARDLC Services June 24 in Orleans Parish District Court.

Freire claims that while she was shopping in the Winn-Dixie located on Holiday Drive in New Orleans in July 2009, she slipped in a puddle of water on the floor and fell. Freire says she hurt her spine, shoulder, ankle and knee when she fell.

Winn-Dixie is accused of negligence for failing to maintain a safe aisle for their customers, failing to place any warning cones in the vicinity of the wet floor and having knowledge of the unsafe condition of the aisle and failing to take any remedial action. Southern Cleaning Services and ARDLC Services are accused of negligence by causing a hazardous condition through their failure to adequately dry the floor and improper use of the floor cleaning equipment.

Freire is seeking damages for loss of insurability, medical expenses, physical pain and suffering, medical anguish, interest and court costs.

New Orleans attorneys Gerald Leydecker, James Leydecker and Craig Leydecker are representing the petitioner.

Judge Paulette R. Irons is assigned to the case.
