A seaman blames his employer for an injury he says he suffered while lifting boxes of frozen meat.
Ambrose Gabriel filed a lawsuit against Keystone Shipping June 21 in federal court in New Orleans.
Gabriel says he was injured in December 2009 while working as a Jones Act seaman aboard the Steamship Delaware Trader. Gabriel says he suffered a hernia while lifting boxes of frozen meat without assistance.
The defendant is accused of negligence for failing to provide competent supervision and failing to provide sufficient crew for the task. Gabriel says those conditions also make the Delaware Trader unseaworthy.
The plaintiff is seeking damages for maintenance, unearned wages, physical pain and suffering, mental pain and suffering, loss of earnings, loss of earning capacity, medical expenses, disfigurement, loss of enjoyment of life, permanent disability, interest and court costs.
New Orleans attorney Stephen P. Bruno is representing Gabriel.
U.S. District Judge Helen G. Berrigan is assigned to the case.
