Apartment visitor sues after falling down stairs in party room

A guest at Willowbrook Apartments in New Orleans is suing the property owner after she allegedly fell down the interior winding staircase and suffered severe injuries.

Catherine Dixon filed suit against Willowbrook Apartments, Willowbrook Management, ETI, Willowbrook Apartments Partnership, Louisiana Housing Finance Agency and the State of Louisiana July 9 in Orleans Parish District Court.

The incident occurred in August 2009 when Dixon was attempting to leave the property. She was walking down the interior winding staircase located in the "party room," when she fell.

"The defendants failed to properly set-up and/or keep said stairs in good working order, failed to properly maintain/or repair said stairs, failed to properly maintain and/or repair said stars, failed to properly light said stairs and failed to properly warn plaintiff about said defects causing the accident," the complaint reads.

The defendants are accused of negligence for failing to properly design, construct and maintain the stairwell, staircase, lighting system and railing, failing to inspect the property, failing to mark warnings of unsafe areas, failing to warn that the stairs were not properly lighted, and failing to provide safe and/or adequate means of navigating for pedestrians.

Dixon is seeking damages for mental pain and suffering, physical pain and suffering, medical expenses, inconvenience, loss of enjoyment of life, loss of work capacity, interest and court costs.

She is represented by Anthony D. Irpino, K. Adam Avin and Louise Higgins of Irpino Law Firm in New Orleans.

Judge Herbert A. Cade is assigned to the case.
