Shopper sues after slipping in water and falling

A woman is suing Winn-Dixie for loss of enjoyment of life after she allegedly slipped in water and fell while shopping.

Charnelle Stewart filed suit against Winn-Dixie Montgomery July 15 in Orleans Parish District Court.

Stewart states the alleged slip and fall occurred in August 2009 at the store on Chef Menteur Highway in New Orleans. She claims she injured her shoulder, wrist, back, knee and leg.

Winn-Dixie is accused of negligence for failing to properly inspect the premises to identify, remove or repair the dangerous condition, failing to properly maintain the premises, failing to warn patrons of a dangerous condition, and failing to have in effect a proper and adequate safety program.

The plaintiff is seeking damages for pain and suffering, mental anguish, medical expenses, loss of enjoyment of life, lost wages and loss of earning capacity, interest and court costs.

Stewart is represented by Darryl M. Breaux in New Orleans.

Judge Sidney H. Cates, IV is assigned to the case.
