Wal-Mart shopper sues after slipping and falling

A Wal-Mart shopper is suing the store after she slipped on a foreign substance that was on the floor and fell, injuring herself.

Andrea Weese filed suit against Wal-Mart Louisiana, John Doe and ABC Insurance Co. July 14 in Orleans Parish District Court.

The alleged incident occurred in September 2009 at the Wal-Mart on Tchoupitoulas Street in New Orleans.

The defendants are accused of negligence for failing to provide proper maintenance and keep their premises in a safe condition for their customers, failing to make or take timely inspection of the area in question, failing to properly train and supervise their employees as to methods of maintenance, repair, and inspection to insure safe passage for their customers and prevent this type of accident from happening. The defendants also are accused of allowing a dangerous condition -- an unstable display shelf -- to exist for an unreasonable length of time.

The plaintiff is seeking damages for pain and suffering, medical expenses, permanent disability, interest and court costs.

Judge Rosemary Ledet is assigned to the case.
