Lowe's customer sues for $450k after trip and fall

A Lowe's customer wants more than $450,000 after tripping and falling in the parking lot.

Shirley Benson filed suit against Lowe's Home Centers on July 21 in federal court in New Orleans.

The alleged incident happened March 28 at the Lowe's Store on Natchez Drive in Slidell. Benson claims she was walking across the store's parking lot when the heel of her shoe got caught in a hole in the asphalt. Benson states she fell forward violently and sustained serious and disabling injuries.

She accuses the defendant of negligence for failing to maintain its parking lot, thus allowing small potholes to develop.

Benson is seeking more than $450,000 in general damages, medical expenses, interest and court costs.

She is represented by New Orleans attorney Kevin C. Schoenberger.

A jury trial is requested.

U.S. District Judge Eldon E. Fallon is assigned to the case.
