Customer sues Lowe's after tripping over board

After tripping over a board and injuring herself, a Tangipahoa Parish resident is suing Lowe's alleging it failed to maintain its store.

Lynn G. Ferrant filed the lawsuit on Oct. 18 in Tangipahoa Parish District Court. Lowe's removed the case to federal court in New Orleans on Nov. 19.

The accident occurred on Nov. 28, 2009 as Ferrant was walking down a merchandise aisle. She states she fell over a board that was protruding from a merchandise pallet, injuring her shoulder, knee and spine.

Lowe's is accused of negligence for improper housekeeping, failing to warn of a hazard and substandard maintenance.

The plaintiff is seeking damages for medical expenses, physical disability, physical pain and suffering, emotional distress, loss of enjoyment of life, interest and court costs.

Ferrant is represented by Hammond attorney Paul L. Billingsley.

Lowe's denies the allegations and argues that if a condition existed which presented a hazard, it was open and obvious and should have been recognized by Ferrant.

U.S. District Judge Martin L. C. Feldman is assigned to the case.
