Seaman sues after mechanical equipment broke and crushed his hand

A St. James Parish resident is suing his employer after suffering a hand injury when mechanical equipment broke.

Calvin Dumas filed suit against A.M.C. Liftboats Inc. on April 11 in federal court in New Orleans.

The incident occurred on April 19, 2010 as Dumas was working as a cook, deckhand and crane operator aboard the L/B Miss Polly. Dumas states he was lowering a water pump into the water using the vessel's winch when the winch handle broke. The tension from the weight of the water pump caused the broken winch handle to strike his hand and fingers. Dumas states he suffered severe and permanent injuries.

The defendant is accused of negligence for failing to provide a safe place to work, failing to ensure the safe and reasonable maintenance of vessel equipment, failing to properly supervise and maintain appropriate safety standards, failing to maintain appropriate safety standards, failing to properly respond to hazardous conditions and failing to provide proper equipment.

The plaintiff is seeking damages for lost wages, lost income, loss of earning capacity, physical pain and suffering, mental pain and suffering, medical expenses, loss of enjoyment of life and interest.

Dumas is represented by Philip F. Cossich Jr., Darren S. Sumich, David A. Parsiola, Brandon J. Taylor, Darin S. Britt and Danielle E. Treadaway of Cossich, Sumich, Parsiola & Taylor in Belle Chasse. A jury trial is requested.

U.S. District Judge Carl J. Barbier is assigned to the case.
