Target sued after shopper slips in red liquid

A Target shopper is suing after injuring his knee when he slipped and fell.

Eric Davis filed suit against Target Corp. of Minnesota and Ace American Insurance Co. on Oct. 12, 2010 in Jefferson Parish District Court. The case was removed to federal court in New Orleans on April 12.

The slip and fall incident occurred on Jan. 3, 2010 as Davis was shopping at the Target located in Metairie. He states he slipped in a red liquid and fell, injuring his neck, back and left knee.

The defendant is accused of negligence for failing to inspect and maintain proper upkeep of the premises, failing to warn business invitees of possible dangers and failing to take all reasonable care and caution under the circumstances.

The plaintiff is seeking damages for physical pain and suffering, emotional distress, mental anguish, medical expenses, loss of enjoyment of life, court costs and interest.

Davis is represented by Robert J. Caluda of the Caluda Law Firm in Metairie.

U.S. District Judge Ivan L. R. Lemelle is assigned to the case.
