The manufacturer of a hair iron is being sued by an insurance company for more than $190,000 after a house caught on fire causing significant property damage.
Louisiana Farm Bureau Mutual Insurance Co. as partial subrogee to the rights of Rhonda Robicheaux and Gene Robicheaux filed suit against Farouk Systems Inc. on March 24 in Lafourche Parish District Court. The defendant removed the case to federal court in New Orleans on April 28.
The house fire occurred on April 21, 2010 at the Robicheaux's home located in Lockport, the suit claims.
The defendant is accused of negligence for the design, manufacture, and sale of a product with inherent defects, failing to warn prospective purchasers of the likelihood that the hair iron might catch fire and for failing to issue a product recall of an inherently defective product.
The insurance company is represented by Nancy Cromartie of Porteous, Hainkel & Johnson in New Orleans. A jury trial is requested.
U.S. District Judge Jay C. Zainey is assigned to the case.
