An Alabama resident is suing his employer after he slipped in hydraulic fluid that had been leaking from a crane for about a year.

Arguing his employer was negligence for not providing a safe floor surface, A.J. Hatten filed a lawsuit against Tetra Applied Technologies Inc. on Aug. 25 in federal court in New Orleans.

The incident occurred on June 15, as Hatten was working on the Tetra 28. He slipped and fell in a puddle of hydraulic fluid from a leaking crane, landing on a tool he was carrying.

The defendant is accused of negligence is failing to maintain a reasonably safe work place, failing to repair the leaking hydraulic fluid for about a year, failing to clean up the hydraulic fluid, in failing to properly train and supervise its employees and in failing to provide a safe flooring surface.

The plaintiff is seeking damages for medical expenses, physical pain and suffering, mental anguish, physical impairment, physical disfigurement, lost earnings, found damages, maintenance, cure, attorney's fees and interest.

Hatten is represented by Steven Gordon of Gordon, Elias & Seely, LLP in Houston. A jury trial is requested.

U.S. District Judge Helen G. Berrigan is assigned to the case.
