Workers' compensation insurer files lawsuit against step stool manufacturer

DONALDSONVILLE – An insurance provider is suing a manufacturer for liability in a workers' compensation settlement.

Luba Casualty Insurance Company filed suit on Feb. 7 in 23rd Judicial District Court against Safety First and Dorel Industries.

The plaintiff claims Fannie Harris, an employee of Top Fuel #4 in Ascension Parish, was injured on the job when she used a step stool manufactured by the defendants.

Luba Casualty Insurance, as the sole provider of workers' compensation insurance for Top Fuel #4, alleges the failure of the step stool as Harris was standing on top of it and depositing ice into an ice machine was the fault of the manufacturer, not the employer. The plaintiff claims Harris was injured when a step on the step stool broke.

The plaintiff claims the defendants were negligent in manufacturing a defective product, equipping the product with a defective piece and failing to warn of the danger.

An unspecified amount in damages is sought for to cover Harris's workers' compensation claim.

Luba is being represented by attorney David T. Butler, Jr. of Baton Rouge.

The case has been assigned to Division E Judge Alvin Turner, Jr.
