GRETNA – A Jefferson Parish woman is suing for injuries she says she sustained on the property of a Harvey casino.
Janice Westerfield filed suit on Feb. 23 against Boomtown Casino in 24th Judicial District Court.
Westerfield claims she and her husband visited Asia, a restaurant within the casino, and that their waiter moved a caution sign from near their table to another table when they were seated. The plaintiff asserts when she got up to go outside for a cigarette she slipped on an unidentified substance that was under the table and fell on her buttocks and back.
Westerfield alleges the waiter who seated them attempted to discreetly move the caution sign back in its original place after her husband came to her aid. The plaintiff is accusing the defendant of failing to exercise reasonable care, failing to provide a premises free of hazardous condition and failing to warn of the hazard.
An unspecified amount in damages is sought for medical expenses, pain and suffering, mental anguish and permanent physical impairment.
Westerfield is being represented by Marcus J. Poulliard of New Orleans-based Frischhertz and Associates.
The case has been assigned to Division J Judge Stephen J. Windhorst.
