Delivery truck driver suing customer for injuries he claims he received while unloading truck

NEW ORLEANS – A delivery truck driver is suing a business where he was making a delivery for injuries he claims to have received while helping unload the order.

Joseph Pierre filed suit on Feb. 17 in Orleans Parish Civil District Court against Hanson Pipe & Precast and its insurer. Pierre claims he was tying a load of metal forms to his truck when he was injured after one of the defendant's employees let them drop.

The plaintiff alleges the employee should have been under the care, custody and control of the employer and thus the defendant should be liable for the damages. The defendant is accused of failing to perform duties in safe manner, failure to maintain control of machinery, failing to keep a lookout and failing to exercise reasonable care.

An unspecified amount in damages is sought for pain and suffering and severe physical and mental injury.

Pierre is being represented by Avondale-based attorney Alfred C. Barrerra.

The case has been assigned to Division A Judge Tiffany G. Chase.
