Fantastic Sam's salon sues shampoo chair manufacturer in workers' compensation case

GRETNA – A Jefferson Parish salon is suing a shampoo chair manufacturer over injuries one of their employee's allegedly received while picking a customer off the floor after the chair broke.

Fantastic Sam's, B and W Inc. and their insurer filed suit on March 26, 2012 against Koken Manufacturing Company, Takara Belmont USA, Inc. and their insurers in the 24th Judicial District Court. The plaintiffs allege a shampoo chair manufactured by the defendants collapsed to the ground while a customer was sitting in it.

Tenita Foster, a hair stylist at Fantastic Sam's, claims she received serious injuries to her back and left shoulder due to picking the patron off the floor with assistance from another employee.

The defendants are accused of manufacturing a product that was inherently dangerous in its design.

The plaintiffs assert that benefits paid to Foster under the Louisiana Workers' Compensation Act should be reimbursed by the defendants.

Damages in the amount paid to Foster for workers' compensation plus legal costs and interests are requested.

Fantastic Sam's is represented by Robert J. May of Metairie-based Juge, Napolitano, Guilbeau, Ruli, Frieman and Whiteley.

The case has been assigned to Division N Judge Hans J. Liljeberg.
