Insurer sued for granting flood policy that was invalidated by flood season

GRETNA – The owners of a Terrebonne Parish golf course have filed suit against their insurer in part for failing to know what should have been known.

Blackhawk Woods, LLC, Kenneth M. Woods, Sr. and Grady Weeks filed suit against Hub International Midwest Limited in the Orleans Parish Civil District Court on July 12.

The plaintiffs claim Hub International provided seven insurance policies on Blackhawk Properties. The plaintiffs allege soon after receiving a flood insurance policy, a flood event happened on the property. The plaintiffs say they filed an insurance claim with Hub to repair damage in the flood, however, they found FEMA had issued a flood warning in the area less than two weeks before the flood, thus invalidating the claim.

The defendant is accused of not knowing a flood event had already started to occur, misrepresentation, breach of insurance contract and failing to know what should have been known.

An unspecified amount in damages is sought for all resulting damages.

The plaintiffs are represented by Houma-based attorney J. Christopher Erny.

The case has been assigned to Division I Judge Nancy A. Miller.
