GRETNA – A New Orleans woman is suing a local law enforcement agency and one of its officers claiming their negligence led to her injuries in a car accident.
Tekana Gainer filed suit against Nicholas Buttone and the Jefferson Parish Sheriff's Office in the 24th Judicial District on July 16. Gainer claims a police cruiser operated by Deputy Buttone ran into the rear of her vehicle when she was stopped on Edenborn Avenue in Metairie. The plaintiff alleges she was seriously injured in the accident.
The defendant is accused of negligence by failing to maintain proper control of his vehicle, failing to keep a proper lookout, failing to try and avoid the accident, following too closely, failing to use the degree of care required, failing to see what should have been seen and careless operation of a motor vehicle.
An unspecified amount in damages is sought for medical expenses, pain and suffering, mental anguish, injuries to her body, loss of enjoyment of life and lost wages.
