Lowe's sued by employee allegedly terminated for refusing to climb a ladder

NEW ORLEANS - An employee who lost her job after she refused to climb a ladder has filed a lawsuit against Lowe's for allegedly failing to accommodate her vertigo.

Susan Fascio filed suit against Lowe's Home Centers Inc. on June 18 in St. Tammany Parish District Court.

Fascio states she was fired from Lowe's for failing to climb a ladder, which she claims was prohibited by her vertigo and medications.

According to the lawsuit, Fascio provided her employer with written restrictions from her physician on Dec. 14, 2010.

Lowe's is accused of failing to accommodate Fascio's disability.

The plaintiff is seeking an award of compensatory damages, back pay, benefits, reinstatement, front pay, attorney's fees, court costs, and interest.

Fascio is represented by Avondale attorney Deborah L. Faust and Metairie attorney Mark Kuss.

U.S. District Judge Helen G. Berrigan is assigned to the case.
