Contractor sues city over Harrison Avenue project

NEW ORLEANS – A local construction company is suing the city through Mayor Mitch Landrieu seeking to prevent the city from contracting with a competitor for the Harrison Avenue construction project.

Command Construction Industries, LLC filed a lawsuit against the City of New Orleans in the Orleans Parish Central District Court on Aug. 17. According to the case filing, Command Construction was the lowest bidding contractor in the running for the Harrison Avenue construction contract.

The plaintiff claims that another construction company, Durr Constructions, should not have received the contract because it was in violation of the Public Bid Law, which prohibits contractors from bidding after bid opening and also states that the lowest bidding contractor gets the contract. Durr re-submitted a bid citing a "clerical error" after the bid opening.

The plaintiff asserts that according to law that action is unlawful and the job rightfully belongs to its company.

Command is represented by Denise C. Puente of New Orleans-based Simon, Pergrine, Smith & Peragine.

This case has been assigned to Division D Judge Lloyd J. Medley.

Case no. 2012-08092.
