NEW ORLEANS – A man delivering a package to a Poydras Street establishment is suing the owners of the premises, the managers and controllers, and the elevator company responsible for maintenance and control of the elevator in which he was allegedly trapped.
Thomas P. Brewer filed a lawsuit against East Skelly, LLC, Jones Lang Lasalle Services, Inc. and Otis Elevator Company in the Orleans Parish Central District Court on Aug. 24.
Brewer claims he was trapped in an elevator for more than an hour and allegedly sustained injuries in the course of his entrapment as a result of the shuddering, the hot temperature in the elevator and an alarm that went off the entire duration of his entrapment. The plaintiff claims he fell, injuring his neck and back and suffered extreme anxiety and a headache.
The defendant is accused of failure to properly maintain the elevator, failure to promptly attempt to rescue him and failure to warn patron of the dangerousness of the elevator.
An unspecified amount is sought for all damages including all medical expenses the plaintiff has accumulated following the incident and pain and suffering.
