Arby’s sued by man who was allegedly hurt in fall on ramp

GRETNA – A Jefferson Parish man is suing a local Arby's restaurant for injuries he claims to have received in a fall on its premises.

John C. Hose filed suit against Miracle Restaurant Group LLC, Arby’s Roast Beef and First Mercury Insurance Company in the 24th Judicial District Court on Oct. 30. Hose claims that he was exiting the Arby’s located on Veteran’s Boulevard in Metairie via a ramp when he slipped backwards and fell. The plaintiff alleges he stuck out his right arm to break his fall, which resulted in a serious and debilitating injury to his right shoulder.

The defendant is accused of failing to warn and allowing an unreasonably dangerous condition or defect to exist on the property due to the slope of the ramp and the lack of handrails.

An unspecified amount in damages is sought for future pain, suffering, loss of enjoyment of life’s pleasures, permanent impairment, loss of function, loss of range of motion, medical expenses, loss of income, loss of earning capacity and mental anguish.

Hose is represented by New Orleans-based attorney Jonathan P. Friedman.

The case has been assigned to Division M Judge Henry G. Sullivan.
