Woman who tripped over case of Yoo-hoo suing Winn-Dixie

GRETNA – A Jefferson Parish woman has filed suit against a local location of grocery store chain for injuries she claims to have received on their premises.

Ruth Graves filed suit against Winn-Dixie Montgomery, LLC d/b/a Winn-Dixie 1070 Westbank Expressway, Westego, La. in the 24th Judicial District Court on Nov. 2. Graves claims that she was being assisted by a store employee who handed her a four pack of drinks and when she turned to put them in her cart she tripped on a package of drinks on the floor that was partially obscured by a post causing her to fall to the floor an injure herself. The plaintiff alleges that she received injuries to her leg, left knee, a sprained ankle and a back sprain.

The defendant is accused of not putting drinks in the proper place on the shelf, leaving drinks on the floor partially hidden from view, not making sure the pathway was clear after assisting the customer and leaving the drinks on the floor for a long period of time.

An unspecified amount in damages is sought for physical pain and suffering, mental pain and anguish, medical expenses, loss of wages, loss of earning capacity, loss of enjoyment of life, permanent disability and impairment.

The case has been assigned to Division G Judge Robert A. Pitre.
