Lakeside Shopping Center sued by for permanent disability after woman trips on sidewalk

GRETNA – A New Orleans woman is suing a shopping mall complex after tripping on an indentation in a sidewalk and falling to the ground.

Lidia A. Everett filed suit against Greater Lakeside Corporation, Inc., 3300 N. Causeway Blvd. Associates, LLC and Chubb Services Corporation in the 24th Judicial District Court on Dec. 6. Everett claims she was walking outside the Dillard’s department store located at the Lakeside Shopping Center when the heel of her shoe was caught in an indentation in the concrete surface in front of the store and she fell to the ground. The plaintiff alleges she was severely injured in the fall and has undergone extensive medical treatments, including surgery, and has permanently lost the use of her left leg.

The defendant is accused of failing to maintain the safety of the premises, failing maintain the sidewalks and walkways in a safe condition, failing to provide visitors with a safe passageway, failing to warn of the hazard, failing to exercise due care and caution for the safety of visitors, failing to keep the concrete surface in good repair, failing to have adequate lighting, creating a defective condition and failing to post adequate warning signs.

An unspecified amount in damages is sought for pain and suffering, mental anguish and distress, medical expenses, loss of wages, permanent disability, permanent loss of use of a limb, disfigurement and loss of future earning capacity.

The case has been assigned to Division I Judge Nancy A. Miller.
