GRETNA – A local entertainment company is suing its landlord over damages caused by a malfunctioning emergency sprinkler system.
Lil Quincy & Pig’s Bouncing Castles LLC filed suit against Esplanade Mall Limited Partnership, The Esplanade and State Farm Fire and Casualty Company in the 24th Judicial District Court on Jan. 3.
Lil Quincy & Pig’s Bouncing Castles claims it entered into a 12-month contract with Esplanade Mall Limited Partnership in November 2011. In December 2011 a malfunctioning sprinkler system went off at the mall despite no fire being present and damaged its property.
The plaintiff alleges that State Farm denied a claim and the landlord also denied payment for the damages.
Lil Quincy & Pig’s Bouncing Castles asserts that its lease agreement with Esplanade Mall Limited Partnership provided that any property damage caused by leaks due to faulty plumbing would be covered.
State Farm is accused of breach of contract, bad faith claims adjusting and negligent claims adjusting.
The Esplanade is accused of breach of contract, breach of lease, maintaining a defective emergency sprinkler system, failing to provide a reasonable premises, failing to maintain the premises in a suitable condition and failing to provide reasonable remediation.
An unspecified amount in damages is sought for property damages, loss of income, repair and remediation, loss of investment value, penalties under Louisiana codes, attorney’s fees and costs of litigation.
