GRETNA – A Jefferson Parish-based baseball training company is suing a warehouse located near its baseball field claiming parts of the warehouse wall deteriorated and fell on the field, damaging it.
Elite Sports Baseball LLC, Craig Hawkins Jr. and Benjamin Bradshaw filed suit against NEMS USA Inc. and White Marsh Transport Inc. in the 24th Judicial District Court on Jan. 15.
Elite Sports Baseball claims the NEMS USA warehouse wall located adjacent to the outfield of its baseball field was falling apart over time and damaging their filed. The plaintiffs allege that cinder blocks that fell from the wall onto their field forced the company to cancel training sessions and baseball games and tournaments. Elite Sports Baseball also asserts that when NEMS USA replaced the wall it trespassed on the field by placing scaffolding and heavy equipment on it, which allegedly served to cause further damage.
The defendant is accused of trespass, negligence and liability for acts of others and of things in its custody.
An unspecified amount of damages is sought for lost profits and revenue from training or instruction sessions that could have been held, lost profits and revenue from baseball games and baseball tournaments that had to be canceled, damaged business reputation as a result of disruption of business operations and damage to field and inconvenience.
