GRETNA – A New Orleans man is suing a Jefferson Parish door company who he says fired him after filing a work comp claim.
Jon Cavanaugh filed suit against Jefferson Door Company Inc. in the 24th Judicial District Court on Jan. 30.
Cavanaugh claims he was working for the company on Feb. 7, 2012 when he was injured while on the job. The plaintiff alleges that due to the injury he was unable to work and he therefore ended up making a substantial workers' compensation claim.
Cavanaugh asserts that on March 21, 2012 he was terminated from his employment with the stated reason being an incident that occurred in October 2012 at a time while he was under probation. Cavanaugh alleges his termination came shortly after he made his worker’s compensation claim.
The defendant is accused of wrongful termination.
An unspecified amount in damages is sought for statutory penalties of up to one year’s wages and attorney’s fees.
Cavanaugh is represented by John B. Fox of New Orleans-based John B. Fox Associates.
The case has been assigned to Division C Judge June Berry Darensburg.
