Woman who tripped over case of drinks sues pharmacy

GRETNA – A Jefferson Parish woman is suing a local pharmacy after she tripped and fell over a case of drinks that were in an aisle.

Sandra Folse filed suit against CVS Pharmacy Inc. and their insurer in the 24th Judicial District Court on Feb. 21.

Folse claims she was a patron at the CVS Pharmacy located at 2105 Cleary Ave. in Metairie on May 9, 2012 when she turned a corner and tripped over a case of drinks that were in the walkway. The plaintiff alleges that the box was directly in her path and that she was injured when she fell forward and her shopping cart ended up on top of her. Folse asserts she received injuries to her right foot, right shoulder, right side and right leg.

The defendant is accused of negligence for placing the case of drinks in a way that made the defect unnoticeable by the plaintiff until she already fell and injured herself.

An unspecified amount in damages is sought for pain and suffering, medical expenses, loss of enjoyment of life and need for future surgery.

Folse is represented by J. Michael Daly of Metairie-based Walker Daly LLP.

The case has been assigned to Division M Judge Henry G. Sullivan Jr.
