GRETNA – An audio installation contractor is suing an audio parts supplier over breach of contract claims.
E.Q. Flatts Inc. and Sound Chek Music filed suit against RSPE Audio Solutions Inc. in the 24th Judicial District Court.
E.Q. Flatts Inc. claims it entered into an agreement on Aug. 24, 2012 with Audio Solutions Inc. and made a deposit of $60,000 for $270,000 worth of audio components that would be delivered at a later date. They plaintiffs allege that the audio components were to be delivered as part of a contract with an independent film company in New Orleans.
E.Q. Flatts Inc. asserts that even though they gave RSPE Audio Solutions Inc warning that it would likely not need the audio components, RSPE did not return the $60,000 deposit. The plaintiff claims at most 20 percent of the deposit should have been kept by the defendant for a re-stocking fee, but because it never received the audio parts from their wholesaler they should have returned the entire deposit.
The defendant is accused of breach of contract.
Damages in the amount of $60,000 is sought by the plaintiff.
