Construction company sued by subcontractor for alleged non-payment

Breach of contract

GRETNA – A Kenner construction company is suing a contractor for alleged non-payment.

Fleming Construction Company LLC filed suit against Devier Design Build LLC in the 24th Judicial District Court on March. 15.

Fleming Construction Company claims it was subcontracted by Devier Design Build to contribute work to the Mary Queen of Peace project located at 1501 W. Causeway Approach in Mandeville.

The plaintiff alleges that it completed all the work under the contract, but was never paid. Fleming Construction Company asserts it sent a demand letter to Devier Design Build on Jan. 20, 2013 for $21,000, to which no response was received.

The defendant is accused of breach of contract, intentional or negligent misrepresentation, liability and violation of state law.

Damages in the amount of $21,000 plus legal interest and attorney’s fees are sought by the plaintiff.

Fleming Construction Company is represented by attorney Clarence F. Favret III of New Orleans.

The case has been assigned to Division L Judge Donald A. Rowan Jr.
