Company awarded Grand Isle Library construction contract sued by subcontractor for alleged non-payment

Breach of contract

GRETNA – A St. Charles Parish subcontractor is suing a contractor for alleged non-payment on a Jefferson Parish construction project.

TMB Services LLC filed suit against CATCO General Contractors LLC, The Hanover Insurance Company and the Jefferson Parish Council in the 24th Judicial District Court on March 28.

TMB Services claims it was subcontracted by CATCO to provide labor and materials on the Grand Isle library construction project for the Jefferson Parish government.

TMB asserts that on July 26, 2010, after the contract had been signed, the owner of CATCO died and all work on the project was suddenly stopped. The plaintiff claims that on Aug. 20, 2011 it submitted three pay applications under the subcontract in the amount of $24,255, but never received any payment. CATCO allegedly made notice to Jefferson Parish that it was abandoning the project and on Dec. 2, 2011 the parish declared CATCO in default of the contract and brokered a takeover agreement with Hanover.

The defendant is accused of breach of contract and unjust enrichment.

Damages in the amount of $24,255 plus 10 percent in attorney’s fees is sought by the plaintiff.

TMB Services is represented by Jeffrey M. Siemssen of Metairie-based Nicaud & Siemssen LLC.

The case has been assigned to Division H Judge Glenn B. Ansardi.
