GRETNA – A Jefferson Parish man is suing his former employer for alleged discrimination and retaliation related to a workers’ compensation claim.
Hui Guo Chan filed suit against Ochsner Clinic Foundation, a Professional Corporation, in the 24th Judicial District Court on April 10.
Chan claims he was injured in a work-related accident on Sept. 15, 2011 and that afterward he filed a workers’ compensation claim against Ochsner and was out of work for two months. The plaintiff alleges that after he brought the claim he was subjected to discrimination due to his race and nationality and suffered a severe and pervasive hostile work environment. Chan asserts that in his 23 years working for Ochsner he had only been written up twice, but after his injury he was continually harassed and then terminated.
The defendant is accused of not providing a safe work environment and breach of duty.
An unspecified amount in damages is sought for loss of wages, loss of earning, loss of earning potential, severe emotional distress, pain and suffering, great bodily injury, attorney’s fees for handling and prosecuting the matter, any penalties applicable under state law, judicial interest and costs and interest on attorney’s fees.
Chan is represented by attorney Jean-Paul Robert of Gonzales.
The case has been assigned to Division H Judge Glenn B. Ansardi.
