Brother’s Food Mart sued by man who slipped on painted concrete

GRETNA – A St. Tammany Parish man is suing a local gas station where he claims to have received serious injuries in a slip and fall on painted concrete.

Samuel Doughty, and wife Beverly, filed suit against Brothers Petroleum LLC, Imad Faiez Hamdan and Mesa Underwriters Specialty Insurance Company in the 24th Judicial District Court on May 2.

Doughty claims on Sept. 27, 2012 he was a customer at the Brothers Food Mart Store located at 3124 Downs Blvd. in Metairie when he was stepping off a curb and slipped on the painted concrete below. The plaintiff alleges that the painted surface of the concrete was dangerously slippery and resulted in the fall. Doughty asserts that he was severely injured in the incident.

The defendant is accused of failing to keep the property in a reasonably safe condition, failing to keep the property free of unreasonable risk of harm, careless attention to potential dangers, failing to address risks of unreasonable harm, failing to correct an unreasonably dangerous condition, failing to warn customers, failing to avoid a foreseeable dangerous incident, failing to know what should have been known about the defect, crating the risk of harm, failing to use appropriate paint or a no-skid surface, allowing an unreasonable risk of harm, failing to adequately warn of the potential danger, failing to place visible warning signs near or upon the slick and wet walkway and failing to instruct employees to place signs around the area.

An unspecified amount in damages is sought for pain and suffering, mental anguish, medical expenses, lost wages, loss of earning capacity, loss of enjoyment of life and permanent disability.

Doughty is represented by Paul D. Hesse of Slidell-based Jones Lagarde LLC.

The case has been assigned to Division L Judge Donald A. Rowan Jr.
