GRETNA – A Gretna man is suing two area construction companies for allegedly paving over drains located in the street that later resulted in his home flooding after subsequent heavy rainfall.
Richard Rabaca filed suit against Barrier Construction Company LLC and Command Construction Industries LLC in the 24th Judicial District Court on May 8.
On May 15, 2012 Rabaca claims that Barrier Construction Company and Command Construction Industries repaved the road in front of his home located at 801 Madison St. in Gretna and in doing so paved over drains in the roadway. The plaintiff alleges that later in the same day a large amount of rain fell in the area and because the drains were closed water rose in the street and entered his home causing damage.
The defendant is accused of failing to follow industry standards, failing to provide adequate avenues of drainage, failing to warn property owner that flood could results from road paving activities and failing to act as a reasonable company.
An unspecified amount in damages is sought for damage to immovable structure, loss of furniture, loss of electronics, opportunity costs and mental anguish.

The case has been assigned to Division A Judge Raymond S. Steib Jr.
