Woman who allegedly fell in water in garden section of Wal-Mart sues for multiple injuries

GRETNA – A Jefferson Parish woman is suing a corporate retailer for injuries she claims to have received in a fall at one of its local stores.

Janice Cuccia filed suit against Wal-Mart Stores Inc. and Wal-Mart Louisiana LLC in the 24th Judicial District Court on May 10. Cuccia claims she was shopping in the garden section of the Wal-Mart located at 5110 Jefferson Highway in Harahan when she slipped and fell in standing water. The plaintiff alleges that she received multiple injuries in the fall to her neck, back, left shoulder, rotator cuff, right elbow and thumb.

The defendant is accused of failing to provide a safe place to walk and failing to warn of a dangerous condition.

An unspecified amount in damages is sought for physician’s professional services, prescription medications, pain and suffering, neurosis, medical expenses, emotional distress, loss of enjoyment of life, loss of work and loss of earning capacity.

Cuccia is represented by attorney Brad C. Cashio of Kenner.

The case has been assigned to Division O Judge Ross P. LaDart.
