GRETNA – A Mississippi woman is suing a Jefferson Parish doctor for allegedly botching what should have been a small surgery
Linda Bolton, and husband Frazier, filed suit against Dr. David Margolin in the 24th Judicial District Court on June 28.
Bolton claims that she visited Ochsner Hospital on June 24, 2009 for a minimally invasive surgery on her large intestine that was converted to an open procedure. The plaintiff alleges that the procedure was changed due to complications. Bolton asserts that she was admitted to the hospital in July 2011 and October 2012 to undergo further corrective surgery due to the complications.
The defendant is accused of failing to exercise due care, failing to properly evaluate the patient before performing surgery, failing to recommend a proper course of treatment before performing the surgery, failing to discuss the risks and benefits of the procedure or recommend alternative treatments, performance of an unnecessary and non-indicated surgery and failing to comply with applicable standards.
An unspecified amount in damages is sought for pain and suffering, mental anguish, medical treatment, medical expenses, medical complications, lost wages, disability and loss of enjoyment of life.

The case has been assigned to Division L Judge Donald A. Rowan Jr.
