Condo association sued by owner claiming unrepaired leaks caused mold growth

GRETNA – A condo association is being sued by a condo owner for allegedly not fixing leaks in the building that have resulted in mold growth making the property uninhabitable.

Jesus Hernandez filed suit against the Peachtree Condominium Association Inc., Columbia Property Management Inc. and Under Pressure Construction Inc. in the 24th Judicial District Court on Aug. 2.

Hernandez claims in August the roof above his condo unit located within the Peachtree Condominium Association located at 4829 Wabash St. in Metairie began leaking. The plaintiff alleges that despite his pleas to the defendants to repair the leak for which Under Pressure Construction was contracted to make, the leak continued. Hernandez asserts that water entering into his condominium resulted in the growth of mold that made the property uninhabitable and that despite this a long-term fix for the leak still has not been made.

The defendant is accused of failing to provide competent property management, failing to hire a competent firm to perform repairs and failing to ensure repair.

An unspecified amount in damages is sought for loss of rent, loss of peaceable enjoyment, loss of ability to sell property, loss of use and repair damages.

Hernandez is represented by attorney Stephen M. Petit Jr. of Metairie.

The case has been assigned to Division A Judge Raymond S. Steib Jr.
