Walgreens sued by man who alleges he was injured by stock cart

GRETNA – Walgreens is being sued by a man who claims he was injured when an employee pushed a stock cart into him causing him to fall.

Shannon Diamond, and wife Wendy, filed suit against Walgreen Louisiana Company Inc., Walgreens store No. 05633 LLC and an unknown employee in the 24th Judicial District Court on Sept. 17.

Diamond claims he visited the Walgreens located at 2570 Barataria Blvd. in Marrero on Sept. 22, 2012 to use the restroom. The plaintiff alleges that as he was walking behind an employee who was going to unlock the restroom another employee pushed a stock cart into him and he fell to the ground. Diamond asserts he was injured in the incident after the cart struck him in the abdomen where he has a urostomy bag and resulted in severe personal and internal injuries to pre-existing conditions.

The defendant is accused of failing to see what should have been seen, carelessly pushing a stock cart, failing to warn of a dangerous situation, creating a dangerous situation, failing to properly train employees, failing to supervise employees and failing to keep aisles safe for customers.

An unspecified amount in damages is sought for pain and suffering, medical expenses, mental suffering, loss of enjoyment of life and loss of earning capacity.

Diamond is represented by Jack P. Ruli Jr. of New Orleans-based Gennusa Piacun & Ruli.

The case has been assigned to Division H Judge Glenn B. Ansardi.
