GRETNA – An upscale retailer is being sued by a woman who claims she was injured by a ladder that hit her when it slipped out from beneath an employee who fell from it.
Carolyn Barbarin filed suit against Cost Plus Inc. and Safety National Insurance in the 24th Judicial District Court on Oct. 9.
Barbarin alleges that she was shopping at the Cost Plus World Market located at 1617 Westbank Expressway in Harvey. The plaintiff asserts that during her visit an employee fell from atop a ladder causing the ladder to strike her and knock her to the floor. Barbarin claims the incident resulted in severe personal injuries.
The defendant is accused of failing to exercise reasonable care, failing to maintain the store’s equipment, failing to notify the invitees of the danger and creating a dangerous condition.
An unspecified amount in damages is sought for physical injuries, loss of wages, loss of wage earning capacity, medical expenses, physical pain and suffering, loss of enjoyment of life and mental distress.
Barbarin is represented by attorney James Paul Leydecker of New Orleans.
The case has been assigned to Division J Judge Stephen C. Grefer.
