Former co-owner of failed horse dealership sues partner over alleged non-payment of debt

GRETNA – The co-owner of a failed horse dealership is suing his former partner for allegedly failing to pay on a loan the two signed together for their business.

Benjamin J. Harrell filed suit against Chris M. Zimmerman in the 24th Judicial District Court on Dec. 12.

Harrell asserts he was the co-owner with Zimmerman of the Iron Horse and dealt in the wholesaling of horses. The plaintiff claims that while they were in business together he and the defendant signed for a $50,000 loan together. Harrell alleges that after the Iron Horse was dissolved in March 2013 he and Zimmerman were still responsible for paying the loan, but Zimmerman would not respond to his requests to make payments on the loan. The plaintiff asserts he and the defendant still owe $46,696.80 on the loan.

The defendant is accused of breach of contract.

Damages in the amount of $23,591.61 are sought by the plaintiff.

Harrell is represented by Ryan D. Kelley of New Orleans-based Kinney, Ellinghausen, Richard & Deshazo.

The case has been assigned to Division M Judge Henry G. Sullivan Jr.
