NEW ORLEANS – A contractor is suing a construction company over an unpaid loan.
Kenneth M. Tamm and KMT Painting and Decorating LLC filed suit against Kenneth L. Inman and Inman Construction Services Inc. in the Orleans Parish Civil District Court on Dec. 4, 2013.
KMT claims it made an oral agreement with Inman and ICS where KMT would loan ICS $30,000. On Nov. 30, 2010 ICS issued check to repay Tamm for $30,000, which he deposited into his Capitol One account. On Dec. 21, 2010 the drawee bank Capitol One dishonored the check. On Oct. 28, 2013 Tamm made a written demand upon ICS through certified mail for repayment. On Nov. 19, 2013 certified mail was returned to sender as unclaimed.
Plaintiff is seeking twice the amount of the check plus a service charge of 5 percent. Otherwise, KMT alleges that ICS breached its obligation to repay KMT the $30,000 and therefore Southern is liable to KMT for all damages caused or arising from ICS’s breach, the suit claims.
