Restaurant sued by woman for broken arm from fall over parking stop

GRETNA – A local restaurant is being sued by a customer who claims she broke her arm due to a fall over a parking stop in their parking lot.

Michelle Newton-Chubb filed suit against RDDS Inc., Village Inn Restaurant, Denis Kelley, Shawn Kelley and their insurer in the 24th Judicial District Court on Feb. 18.

Newton-Chubb claims she was walking across the parking lot at Village Inn located at 9201 Jefferson Highway in Jefferson when she tripped over a concrete parking stop. The plaintiff alleges the incident was due to poor lighting in the area and that the parking stop was misplaced. Newton-Chubb asserts she fractured her arm in the fall.

The defendant is accused of allowing dangerous and defective conditions to exist in their parking lot and failing to take reasonable measures to insure the parking lot was safe.

An unspecified amount in damages is sought for pain and suffering, medical expenses, loss of wages and partial disability of her left arm.

Newton-Chubb is represented by Carl A. Butler of Metairie-based Leblanc Butler LLC.

The case has been assigned to Division H Judge Glenn B. Ansardi.
