Insurer sued by medical clinics over Hurricane Isaac damage

GRETNA – A pair of medical clinics are suing their property insurer for allegedly not covering property damage caused by Hurricane Isaac.

Advanced Sleep Center Inc. and Advanced Neurodiagnostic Center Inc. filed suit against Certain Underwriters at Lloyd’s London in the 24th Judicial District Court on Feb. 18.

Advanced Sleep Center Inc. and Advanced Neurodiagnostic Center Inc. allege they held an insurance policy provided by Lloyd's on June 29, 2012, for their property located at 2905 Kingman St. in Metairie.

The plaintiffs allege that in July 2013 they invoked the appraisal provision under its terms of policy, but Lloyd’s of London refused to participate in the appraisal process in violation of the contract’s terms.

Advanced Sleep Center Inc. and Advanced Neurodiagnostic Center Inc. claim that the loss occurred over a year ago and that since that time they have retained a panel of individuals to properly assess damages to their building that occurred during Hurricane Isaac in August 2012.

The defendant is accused of breach of contract, bad faith claims adjusting, negligent claims adjusting and intentional infliction of emotional distress.

An unspecified amount in damages is sought for property damage, loss of use and enjoyment of property, repair and remediation expenses, loss of investment value, diminution of value of property, mental anguish, inconvenience, anguish, penalties assessed under state law and attorney’s fees.

Advanced Sleep Center Inc. and Advanced Neurodiagnostic Center Inc. are represented by Michael S. Brandner of the New Orleans-based Brandner Law Firm LLC.

The case has been assigned to Division P Judge Lee V. Faulkner Jr.
