Cement company sues for $60K over breach of contract

NEW ORLEANS – A Delaware-based cement company is suing a local construction company for allegedly receiving a large shipment of cement as per contract, but failing to render any payment and breaching contract.

Holcim US Inc. filed suit against Owens and Sons Inc. in the Orleans Parish Civil District Court on Nov. 3, 2014.

The plaintiff claims that the defendant received all the cement-related goods and services agreed-upon in a timely fashion but breached a contract in the amount of $60,477.06. The defendant is accused of receiving and utilizing the materials and services as indicated in the original contracts for its own gain.

The plaintiff seeks payment of the original contract in the amount of $60,477.06 as well as late fees and attorney fees.

The plaintiff is represented by Robin B. Cheatham and Scott R. Cheatham of New Orleans-based law firm Adams and Reese LLP.

The case has been assigned to Div. G Judge Robin M. Giarruso.
