NEW ORLEANS – A man is suing First Insurance Company and FESS Security for allegedly assaulting him and further causing harm to his son.

Paul Cosma, individually and his minor son, filed suit against First Mercury Insurance Company and FESS Inc. in the Orleans Parish District Court on April 8.

Paul Cosma alleges that during the French Quarter Festival in New Orleans he was attacked from behind by a unidentified member of FESS Security. Cosma claims he, two of his friends and his son were walking from the Riverwalk Stage towards the intersection of Canal Street and Convention Center Boulevard and that after passing the exit barricade near the Audubon Aquarium of the Americas he was approached by the FESS Security member who told Cosma to enter the festival and exit through a different gate.Without any warning the FESS Security purportedly wrapped his arm around Cosma’s neck and threw him to the ground. Cosma claims that he landed against a table which hit his son, who in the process was injured and sustained emotional damages witnessing his father being assaulted. The petitioner sustained injuries including his right shoulder which caused extreme pain and tremors requiring medical treatment and surgery. The plaintiff asserts his son sustained physical injury and emotional distress in the incident.

The defendant is accused of assault and battery, infliction of emotional distress and acting with indifference toward the safety of others.

An unspecified amount in damages is sought for the plaintiff’s physical pain and suffering, mental pain and suffering, medical expenses and permanent injury.

The petitioner is represented by Daniel A. Meyer of Bruno & Bruno LLP.

The case has been assigned to Division M Judge Paulette R. Irons.
